1. The Competition

1.1 The title of the competition is Fry’s Popcorn Chick’n Halloween Competition (“Competition”).

2. The Promoter

The promoter is: Livekindly UK Ltd, The Old Bakery, Victoria Road, Bicester, Oxfordshire, England, OX26 6PB.

Any persons entering or participating in this Competition (“Participant”) accept and agree that by entering this Competition they have had an opportunity to read and consider these Terms and Conditions and that they are bound by these Terms and Conditions.

3. The Prize

3.1 One Participant stands a chance of winning £500 cash, a £50 Netflix voucher and a month’s supply of delicious Popcorn Chick’n (8 300g serving size packages worth approximately £3.00 retail value) (“the Prize”).

3.2 The Prize is not transferrable and may not be exchanged for cash or any other items. The Promoter reserves the right to substitute the prize/s with any other prize of comparable commercial value.

4. How To Enter

4.1 The competition will run from 12.00am GMT on 14.10.22 (the “Opening Date”) to 12am GMT on 29.10.22 (the “Closing Date”) inclusive.

4.2 All competition entries must be received by the Promoter All competition entries received after the Closing Date are automatically disqualified.

4.3 To enter the competition:

(a) Complete the entry form, which can be found at https://fryfamilyfood.com/uk/halloween-competition/

(b) No purchase necessary, and there is no charge to register for use of the website.

(c) By filling out the form and entering the contest, all participants, including the winner, give the Promoter permission to publish and publicize your name, image, social media handle and/or profile picture, your nearest geographical location (for example, your nearest city, town or county) and your entry, and we may refer to

you in association with the Competition and/or the Prize, in any and all media, worldwide, in perpetuity, for publicity and PR purposes solely in connection with the Competition and/or Prize.

4.4 The Promoter will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

4.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

5. Results 

5.1 A winner will be chosen by random draw supervised by an independent person on [01.11.22] (“Draw Date”).

6. Eligibility

6.1 The competition is only open to all residents in the UK aged 18 years or over, except:

(a) employees of the Promoter or its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

6.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the Prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

6.3 The Promoter will not accept competition entries that are:

(a) automatically generated by computer;

(b) completed by third parties or in bulk;

(c) illegible, have been altered, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

6.4 There is a limit of one entry to the competition per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

6.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of this prize competition.

7. Winners

7.1 The winner will be notified by telephone (using details provided at entry) before 5 November 2022 and must provide a postal address to claim their Prize. If a winner does not respond to the Promoter within [7] days of being notified by the Promoter, then the winner’s Prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.

7.2 The Prize will be sent to the winner by post within [7] days of being notified of their win.

7.3 The Prize for the winner is non-exchangeable, non-transferable and no cash alternative is offered.

7.4 The decision of the Promoter is final and no correspondence or discussion will be entered into.

7.5 The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.

7.6 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county and winning entry of the Prize winner on www.facebook.com/TheFryFamilyFoodCoUKb no later than [Friday 4th November] (Announcement Date).

7.7 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter customerservices.uk@thelivekindlyco.com. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7.8 The Promoter may require the winner/s to:

(a) provide their name, identity number, and to enable to Promoter to verify the entry;

(b) sign an acknowledgment of receipt of the Prize and indemnity; and

(c) where the entry includes the submission of any work eligible for copyright in terms of the Copyright Act No. 98 of 1978, as amended, conclude an agreement of assignment whereby any rights which the winner may have in respect of such works are transferred to the Promoter.

Should the winner/s refuse to comply with this rule for any reason then the winner shall be deemed to have rejected the Prize, and it shall revert to the Promoter.

7.9 Any winner may be requested to attend the draw and announcement of the winner, to take part in the Promoter’s publicity campaigns or to allow their names and likenesses or other photos, including photos of the winner with the Prize, to be used by the Promoter for promotional purposes. The winner is, however, entitled to decline such requests.

7.10 Where a winner consents to take part in the Promoter’s publicity campaigns, they will not be entitled to any remuneration for such participation and all materials arising from such participation will be the sole property of the Promoter.

7.11 The Prize may not be claimed by a third party on behalf of the winner.

7.12 The Promoter does not accept any responsibility if any winner is not able to take up the Prize.

8. Limitation of Liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

9. Ownership of Competition Entries and Intellectual Property Rights

9.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt.

9.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

9.3 You agree that the Promoter may, but is not required to, make your entry available on its website www.frysfamilyfoods.com and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

10. Data Protection and Publicity 

10.1 The Promoter will only process your personal information as set out in the [Privacy Policy – Fry Family Food UK ]. See also condition 7.6 and condition 7.7, with regard to the announcement of winners.

11. General

11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.

11.3 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
